These Terms govern use of the Fairway Flow ordering platform. When you order food, drinks or other venue products, the venue shown in the ordering experience is the seller and receives your order. Fairway Flow provides the method of ordering and, where enabled, facilitates payment.
1. Who you are buying from
When you place an order through Fairway Flow, you are purchasing the food, drinks or other products from the golf club, venue or other merchant identified in the ordering experience (the Merchant). The Merchant receives your order and is responsible for preparing and fulfilling it.
Fairway Flow provides the technology that lets you view the Merchant's menu, place an order and, where available, make payment. Fairway Flow is not the seller, manufacturer or preparer of the Merchant's food, drinks or other products unless we expressly tell you otherwise.
The Merchant is operating in trade when it offers its products to consumers through Fairway Flow. Nothing in these Terms is intended to reduce rights you may have under New Zealand consumer law.
2. Using Fairway Flow
You can access Fairway Flow through a QR code or other link supplied by a participating Merchant. You do not need to create a customer account unless Fairway Flow introduces an account feature and clearly tells you that one is required.
You must use Fairway Flow lawfully and must not deliberately interfere with, misuse, damage, overload or attempt to gain unauthorised access to the platform or another person's information.
3. Menu information, availability and prices
Menu items, descriptions, prices, availability and venue-specific information are supplied or managed by the Merchant. Prices shown at checkout are in New Zealand dollars unless clearly stated otherwise.
The Merchant is responsible for keeping its menu and availability information reasonably accurate. An item may occasionally become unavailable after you begin an order. If an order cannot be fulfilled as placed, the Merchant should contact you or provide an appropriate remedy.
The total amount payable will be shown before you place an online-paid order. Any important venue-specific condition, such as a cash-only pay-at-pickup option, should also be displayed during checkout rather than relying only on these Terms.
4. Placing an order
Please check your items, selected venue/location, contact details, fulfilment method and payment method before placing an order.
When you submit an order through Fairway Flow, the order is transmitted to the Merchant. The Merchant is responsible for receiving, acknowledging, preparing and fulfilling the order through its normal Fairway Flow workflow.
Submitting an order does not remove any rights or remedies that apply under New Zealand law. If an order cannot be supplied, is materially different from what was ordered, or otherwise fails to meet applicable consumer guarantees, the Merchant remains responsible for providing the remedy required by law.
5. Payments
Where online payment is offered, payment is processed using Stripe's payment infrastructure for the Merchant's connected payment account. Fairway Flow facilitates that payment workflow but does not receive or store your full card number or card security code.
Where the Merchant offers another payment method, such as pay at pickup, the conditions shown at checkout apply. For example, a Merchant may state that pay at pickup is cash only.
Your bank or payment provider may apply its own terms. If an online payment fails or is not completed, the Merchant is not required to treat the order as paid.
6. Pickup and delivery
The fulfilment options available for an order are determined by the Merchant. Depending on the venue, this may include pickup or delivery to an available location shown in Fairway Flow.
You are responsible for selecting or providing accurate fulfilment and contact information. If you move after placing an order or provide incorrect information, contact the Merchant as soon as reasonably possible.
Preparation, pickup and delivery times shown through Fairway Flow should be treated as estimates unless the Merchant expressly states that a particular time is guaranteed. The Merchant remains responsible for carrying out its fulfilment service within the standards required by applicable law.
7. Changes and cancellations
If you want to change or cancel an order, contact the Merchant as soon as possible. Whether a voluntary change or cancellation can be accepted may depend on whether preparation has already started, whether the product can reasonably be resold, and the Merchant's disclosed policy.
A Merchant is not generally required to provide a refund solely because you changed your mind. This does not affect any right to a remedy where the products or services fail to meet applicable legal guarantees.
8. Refunds and order problems
For problems with the food, drinks, fulfilment, missing items, product quality or the order itself, the Merchant is your primary point of contact because the Merchant sold and fulfilled the order.
Where supported, authorised Merchant users can initiate eligible payment refunds through Fairway Flow. Refund processing may then be carried out through Stripe and the relevant banking/card networks.
Fairway Flow's current merchant refund tool may not support every type of refund adjustment. This does not limit a customer's legal rights or the Merchant's obligation to provide an appropriate remedy where required. The Merchant and Fairway Flow may use another reasonable process where necessary to give effect to a lawful remedy.
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited.
9. Food information, allergies and dietary requirements
Food descriptions, ingredients, allergen information and dietary representations displayed in a Merchant's menu are provided or controlled by that Merchant.
If you have a food allergy, intolerance or important dietary requirement, do not rely solely on the Fairway Flow ordering interface. Contact the Merchant directly before ordering if you need to confirm ingredients, preparation practices or cross-contact risks.
Fairway Flow provides the ordering platform and does not independently prepare, inspect or verify the Merchant's food or its ingredient/allergen information.
10. Customer details and communications
Fairway Flow may ask for information such as your name, mobile number and email address where reasonably needed to process, fulfil or confirm your order.
You should provide accurate contact information so the Merchant or Fairway Flow can contact you about the order where necessary.
Transactional communications may include order confirmations, status information, payment/refund information or messages reasonably necessary to provide the service. Our separate Privacy Statement explains how personal information is collected, used, disclosed, stored and protected.
11. Platform availability
Fairway Flow aims to provide a reliable ordering service, but availability can be affected by internet connectivity, Merchant systems or devices, maintenance, payment providers and other third-party services.
If the platform is unavailable, the Merchant may choose to offer another ordering or payment method. Fairway Flow does not promise uninterrupted or error-free availability.
This section does not remove any guarantee or remedy that applies by law to services supplied to you.
12. Merchant responsibility and Fairway Flow responsibility
The Merchant is responsible for the products it sells, menu accuracy, stock availability, food preparation and safety, fulfilment, and its customer-service obligations.
Fairway Flow is responsible for providing the Fairway Flow platform with reasonable care and skill and for dealing with issues that relate to the platform itself.
If you are unsure whether a problem relates to the Merchant or Fairway Flow, you may contact either party and we will reasonably direct the issue to the appropriate place.
13. Consumer rights
These Terms operate alongside New Zealand consumer law. If you are acquiring products or services as a consumer, rights under the Consumer Guarantees Act 1993 and protections under the Fair Trading Act 1986 may apply.
Nothing in these Terms is intended to mislead you about, contract you out of, or reduce any consumer right that cannot lawfully be excluded.
Depending on the circumstances, legal remedies for a problem may include repair, replacement, refund, compensation or another remedy required by law. The appropriate remedy depends on the nature of the problem.
14. Privacy
Use of Fairway Flow involves the collection and handling of personal information. Our Privacy Statement forms the primary customer-facing explanation of Fairway Flow's privacy practices.
The Merchant may also have its own privacy obligations and policies for information it receives in connection with your order.
A link to the Fairway Flow Privacy Statement should be made available where customer information is collected and through the Fairway Flow website.
15. Intellectual property
Fairway Flow owns or licenses the Fairway Flow platform, software, design, branding and related content. Merchants own or license their own names, logos, menu content and other Merchant materials.
You may use Fairway Flow for ordinary personal ordering purposes. You must not copy, scrape, reverse engineer, commercially exploit or reproduce the platform except where permitted by law or with permission.
16. Changes to these Terms
Fairway Flow may update these Terms from time to time to reflect changes to the service, law or business operations.
Updated Terms will apply prospectively from the effective date shown with them. We will not use a later change to these Terms to retrospectively remove rights or materially alter the terms that applied to an order already placed.
Where a change is important to customers, Fairway Flow should take reasonable steps to make the updated terms available before they apply to new orders.
17. Problems, complaints and disputes
For a problem with an order, food, drink, preparation, pickup or delivery, contact the Merchant shown in your order details first.
For a Fairway Flow platform, privacy or technical issue, contact Fairway Flow using the details below.
If a consumer dispute cannot be resolved directly, the parties retain access to any dispute-resolution process, tribunal, regulator or court available under New Zealand law.
18. New Zealand law
These Terms are intended to be governed by New Zealand law. Nothing in this clause limits any mandatory consumer protection or jurisdictional right that applies to you.
